As a result, we are currently in the heyday of 'exclusion claims'." This expresses a direct challenge to current practices at the Japan Patent Office and the courts. It appears that the Japan Patent Office itself recognizes that the handling of exclusion claims in Japan is quite unusual from an international perspective, and the Office seems to be taking steps to address overly permissive use of such claims. Moreover, both the JPO and the courts seem to believe that Japan, in aiming to be the world’s most pro-patent and applicant-friendly country, can rely on opposition procedures to resolve issues that arise from granting rights that perhaps should not have been granted in the first place. This seems to be the reasoning behind allowing such claims. But is this really acceptable? There should be deeper discussion on this matter.
