「除くクレーム」進歩性判断

『阻害要因という誤謬3：「除くクレーム」の審査実態を見る1』（そーとく日記、2025年07月07日）には、『「除くクレーム」について審査基準第IV部第2章には、「引用発明と技術的思想としては顕著に異なる発明ではない場合は、「除くクレーム」とすることによって進歩性欠如の拒絶理由が解消されることはほとんどないと考えられる。」と記載されている。
ところが今の日本は、前回の投稿のとおり、引用発明に必須の構成を除くと阻害要因が認められて進歩性が肯定されるという（誤った）考え方が幅を利かせているためか、「除くクレーム」の全盛期を迎えている。』と、現在の特許庁、裁判所の実務に正面から異論を唱えています。
日本の除くクレーム実務は、国際的にみると極めて特殊であると言わざるを得ないことは、特許庁も自認しているようであり、特許庁も行き過ぎた「除くクレーム」に対する対応を行っているように見えます。
日本の特許庁も裁判所も、日本がプロパテントが世界一出願人にやさしいことを目指し、その結果生じる問題（本当は権利化すべきでないものが権利化されてしまった場合）に関しては当事者が異議を唱える制度が機能しているのでそうした問題は個別に解消されるので問題ないとしているように感じます。
本当にそれでよいのか、もっと議論されるべきでしょう。

In the blog post “The Fallacy of Hindrance Factors 3: Examining the Actual Examination Practices of ‘Exclusion Claims’” (Sōtoku Diary, July 7, 2025), the following is stated:
"According to the Examination Guidelines, Part IV, Chapter 2, it is written that: ‘In cases where the invention is not significantly different in technical concept from the cited invention, it is generally considered that inventive step is unlikely to be affirmed solely by formulating the claim as an "exclusion claim".’
However, as noted in the previous post, in Japan today, there is a (mistaken) prevailing notion that inventive step can be affirmed by excluding essential elements of the cited invention—on the grounds that such exclusion creates a hindrance factor. As a result, we are currently in the heyday of 'exclusion claims'."
This expresses a direct challenge to current practices at the Japan Patent Office and the courts.
It appears that the Japan Patent Office itself recognizes that the handling of exclusion claims in Japan is quite unusual from an international perspective, and the Office seems to be taking steps to address overly permissive use of such claims.
Moreover, both the JPO and the courts seem to believe that Japan, in aiming to be the world’s most pro-patent and applicant-friendly country, can rely on opposition procedures to resolve issues that arise from granting rights that perhaps should not have been granted in the first place. This seems to be the reasoning behind allowing such claims.
But is this really acceptable? There should be deeper discussion on this matter.
