AI-Enabled Training Methods for Developing Young Professionals in Intellectual Property Work
The rapid advancement of generative AI and AI agents is shifting the core value of intellectual property (IP) work from execution to decision-making. At the same time, concerns are growing that younger professionals may increasingly outsource their thinking to AI, potentially hindering the development of fundamental skills and critical thinking abilities.
To explore this issue, I asked a generative AI system to propose AI-enabled training methods for nurturing and developing junior professionals in corporate IP departments. I hope you will find the suggestions informative and useful.

荏原製作所の知財ROIC

2026年5 月28 日に開催されたLexisNexis PatentSight+ Summit 2026では、株式会社荏原製作所 技術経営戦略統括部 知的財産部 高栁 秀樹 部長が、「知財ROICによる知財経営の高度化:荏原製作所における知財ガバナンスと価値評価の実践」というタイトルで、多様な業態を持つ荏原製作所の知財ガバナンスを紹介。管理会計的思考に基づき、知財活動の「質」を定量化する「知財ROIC」の取り組みを解説。また、独自の発明評価と事業特性に合わせた評価の個別最適(レトロフィット)や、同指標を用いた経営層との対話の 深化など、最前線の実務について紹介しました。その内容は、後日、記事として提供されるということです。

Ebara Corporation’s Intellectual Property ROIC
At the LexisNexis PatentSight+ Summit 2026, held on May 28, 2026, Hideki Takayanagi, General Manager of the Intellectual Property Department, Technology Management Strategy Division, Ebara Corporation, delivered a presentation titled:
“Advancing Intellectual Property Management through IP ROIC: Ebara Corporation’s Practices in IP Governance and Value Assessment.”
In this presentation, Mr. Takayanagi introduced Ebara Corporation’s intellectual property governance framework, which supports the company’s diverse business portfolio. He explained the company’s efforts to quantify the quality of intellectual property activities through an IP ROIC (Return on Invested Capital) approach grounded in management accounting principles.
He also discussed cutting-edge practices, including Ebara’s proprietary invention evaluation methodology, the customized optimization (“retrofit”) of evaluation criteria to reflect the characteristics of individual businesses, and the deepening of dialogue with senior management through the use of this metric. According to the presentation, the details will be published in article form at a later date.

令和7年(行ケ)第10023号審決取消請求事件(令和8年4月16日判決言渡)は、発明の名称を「熱可塑性樹脂組成物とそれを用いた樹脂成型品および偏光子保護フィルムならびに樹脂成形品の製造方法」とする発明についての特許無効審判請求を不成立とした審決の取消訴訟で、当業者は主引用発明及び文献に記載された技術的事項に基づき、特許発明と主引用発明との相違点に係る構成を採用することを容易に想到することができたものといえ、かつ、当該特許発明は、その構成が奏するものとして当業者が予測することができなかった効果を奏しているとは認められないとして、特許無効審判請求を不成立とした審決を取り消した事例です。

Reiwa 7 (Gyo-ke) No. 10023, a case seeking rescission of a trial decision (judgment rendered on April 16, Reiwa 8), concerned a request for a patent invalidation trial regarding an invention entitled “Thermoplastic Resin Composition, Resin Molded Article and Polarizer Protective Film Using the Same, and Method for Manufacturing a Resin Molded Article.”
In this case, the court held that a person skilled in the art could have easily conceived of adopting the configuration relating to the differences between the patented invention and the primary cited invention, based on the primary cited invention and the technical matters described in the cited documents. The court also found that the patented invention could not be recognized as producing an effect that a person skilled in the art could not have predicted as resulting from its configuration. Accordingly, the court revoked the trial decision that had found the request for a patent invalidation trial to be groundless.

令和7年(行ケ)第10043号審決取消請求事件(令和8年3月26日判決言渡)は、相違点の容易想到性の判断及び予測できない顕著な効果の判断に誤りがあるとして、審決を取り消した事例です。
原告は、名称を「光拡散層形成用塗料、プロジェクションスクリーン用フィルム、及びプロジェクションスクリーン」とする発明につき特許出願(特願2019-20111 3号。本願)をしたが、拒絶査定(本件拒絶査定)を受け、不服の審判請求をしました。これに対し特許庁は、「本件審判の請求は、成り立たない。」との審決(本件審決)をしたので、原告は、本件訴訟を提起しました。
原告が主張した取消事由は、取消事由1(「樹脂」の種類に関する引用発明の認定の誤り)、取消事由2(「用途」に関する引用発明の認定の誤り)、取消事由3( 相違点の容易想到性判断の誤り)、取消事由4( 予測できない顕著な効果の判断の誤り)及び取消事由5( 審判手続の瑕疵) でした。
本判決は、原告の主張する取消事由1及び2には理由がないが、以下のとおり、取消事由3及び4の各一部には理由があるとして、本件審決を取り消しました。

The case of Reiwa 7 (Gyo-Ke) No. 10043, an action seeking rescission of a JPO trial decision (judgment rendered on March 26, Reiwa 8 [2026]), is a case in which the court rescinded the JPO decision on the grounds that there were errors in the determination of the obviousness of the differences and in the assessment of unpredictable and remarkable effects.
The plaintiff filed a patent application (Japanese Patent Application No. 2019-201113; the “Application”) for an invention entitled “Coating Material for Forming a Light Diffusion Layer, Projection Screen Film, and Projection Screen.” However, after receiving a decision of refusal (the “Refusal Decision”), the plaintiff filed an appeal against the examiner’s decision. In response, the Japan Patent Office rendered a trial decision stating that “the request for appeal in this case is groundless” (the “JPO Decision”). The plaintiff therefore instituted the present action.
The grounds for rescission asserted by the plaintiff were:
(1) Ground 1: Error in the identification of the cited invention regarding the type of “resin”;
(2) Ground 2: Error in the identification of the cited invention regarding the “use”;
(3) Ground 3: Error in the determination of the obviousness of the differences;
(4) Ground 4: Error in the determination regarding unpredictable and remarkable effects; and
(5) Ground 5: Defect in the trial proceedings.
In this judgment, the court held that Grounds 1 and 2 asserted by the plaintiff were without merit. However, the court found that portions of Grounds 3 and 4 were well-founded for the reasons described below, and accordingly rescinded the JPO Decision.

2026年5月22日の読売新聞に『知的財産を企業の「稼ぐ力」に、コンテンツ産業への公的投資「5年で5000億円以上」に拡大求める…自民知財戦略調査会が提言案』という記事がありました。自民党知的財産戦略調査会がまとめた知財戦略の提言案で近く政府に提出され、6月に取りまとめられる「知財推進計画2026」に反映されると考えられます。

TSMC機密情報不正取得、日本企業への教訓

2026年5月20日、半導体製造装置大手・東京エレクトロンの台湾子会社に対する有罪判決が確定しました。この事件は、世界最大のファウンドリである台湾積体電路製造(TSMC)の最先端2nmプロセス技術という「国家核心重要技術」の不正取得を巡るもので、台湾が2022年に改正した国家安全法の「経済スパイ条項」が外国企業(日系企業)に初めて適用された歴史的な判例となりました。判決では、主犯格の元TSMC社員に懲役10年が科されると共に、東京エレクトロン台湾子会社に対しても約7億6000万円の罰金が命じられました。不正を主導した元従業員への監督責任を認めたもので、企業には機密流出だけでなく不正な情報取得を防ぐ仕組みも求められています。

Unauthorized Acquisition of TSMC Confidential Information: Lessons for Japanese Companies
On May 20, 2026, the guilty verdict against the Taiwanese subsidiary of semiconductor manufacturing equipment giant Tokyo Electron became final. The case involved the unauthorized acquisition of “National Core Critical Technology,” specifically the cutting-edge 2nm process technology of Taiwan Semiconductor Manufacturing Company (TSMC), the world’s largest semiconductor foundry. It became a historic precedent as Taiwan’s “economic espionage provisions” under the National Security Act, revised in 2022, were applied for the first time to a foreign company (a Japanese-affiliated company).
In the ruling, the former TSMC employee identified as the principal offender was sentenced to 10 years in prison, while Tokyo Electron’s Taiwanese subsidiary was also fined approximately ¥760 million. The court recognized the company’s supervisory responsibility over the former employee who led the misconduct, signaling that companies are now required not only to prevent the leakage of confidential information, but also to establish mechanisms to prevent the improper acquisition of such information.

“Current and Future Use of AI in Intellectual Property Operations — From ‘Labor-Intensive’ to ‘Knowledge-Intensive and Strategy-Driven’ Workflows”

Lecture Overview:
In 2026, generative AI is evolving from “conversational AI” to “reasoning and autonomous action-oriented AI,” and its full-scale adoption in intellectual property operations is steadily accelerating. Companies are already reporting dramatic efficiency gains, including substantial reductions in patent search workloads and significant decreases in specification drafting time.
In this lecture, I will explain concrete use cases across each phase of IP practice — including prior art search, prosecution, and strategic planning — together with practical examples. I will also discuss how operational processes are shifting from Human-in-the-Loop to Human-on-the-Loop models, and how IP professionals are evolving from “task executors” into “context architects.”
In addition, I will introduce cross-company initiatives being undertaken within the Generative AI Utilization Promotion Council, and together we will explore new IP strategies and career perspectives for the AI era.

Googleが2026年5月19日、年次の技術カンファレンス「Google I/O 2026」で、最新鋭モデル「Gemini 3.5」を発表しました。シリーズの皮切りとして、まずは「Gemini 3.5 Flash」が本日より提供されています。
I/O直前まで、「Gemini 3.5 Proが来る」、「GPT-5.5やClaude Opus 4.7に真正面からぶつける」と期待されていました。しかし実際に発表されたのは、「Gemini 3.5 Flash」、「Gemini Omni」、「Gemini Spark」が中心で、「Gemini 3.5 Pro」は6月に提供されるということで、これに失望した人々もいたようです。そこから、「Google、性能で勝ち切れていないのでは?」という印象につながり、Googleが“性能競争を降りた”という話も出ていました。
ただ、「Googleが性能レースをやめた」というより、“単体モデルのベンチマーク競争”から、“エージェント+実運用プラットフォーム競争”へ軸足を移したというのが正しいようです。

On May 19, 2026, at its annual technology conference “Google I/O 2026,” Google announced its latest flagship AI model, “Gemini 3.5.” As the first release in the series, “Gemini 3.5 Flash” has been made available starting today.
Leading up to I/O, there had been strong expectations that “Gemini 3.5 Pro” would be unveiled and positioned head-to-head against GPT-5.5 and Claude Opus 4.7. However, the actual announcements focused primarily on “Gemini 3.5 Flash,” “Gemini Omni,” and “Gemini Spark,” while “Gemini 3.5 Pro” was said to be coming in June. This appears to have disappointed some observers. As a result, discussions emerged suggesting that “Google may not be winning the performance race,” with some even claiming that Google had “stepped away from the performance competition.”
However, rather than “abandoning the performance race,” it may be more accurate to say that Google is shifting its focus away from “single-model benchmark competition” toward competition centered on “agents plus real-world operational platforms.”

Japan Licensing Association Nara Annual Conference Panel Discussion
I will be speaking on the panel discussion titled “Evolving IP Licensing Through Generative AI and DX: Strategic Transformation in the AI-First Era” (tentative title) at the 47th Japan Licensing Association Nara Annual Conference for FY2026, to be held in Nara City on Friday, July 10, and Saturday, July 11, 2026.
I was invited thanks to my connection from around 20 years ago, when I was active in JIPA’s Licensing Committee.
