USPTO「AI支援発明に関するガイダンス」改訂

2025年11月26日、USPTOは2024年2月13日付で発行されていた「AI支援発明における発明者の決定の関するガイダンス」を撤回し、「『AI を使った発明』であっても発明者として認められるのはあくまで“人間”に限る」という新たなガイダンスを発表しました。
法律上、AIは発明者が使用する「道具 (instruments)」であるという立場の明確化です。
このUSPTOの新ガイダンスについて生成AIに深掘りさせました。

USPTO Revises Its “Guidance on AI-Assisted Inventions”
On November 26, 2025, the USPTO withdrew its previous “Guidance on the Use of AI in Determining Inventorship,” which had been issued on February 13, 2024, and announced a new policy stating that even for “AI-assisted inventions,” only human beings can be recognized as inventors.
This clarifies the legal position that AI is merely an “instrument” used by a human inventor.
