米連邦最高裁のHikma対Amarin訴訟判決

2026年6月4日、米連邦最高裁判所は Hikma Pharmaceuticals USA Inc. v. Amarin Pharma, Inc.(No. 24-889)において全員一致(9対0)で連邦巡回控訴裁判所(CAFC)の判断を破棄し、Hikma社の後発薬はAmarin社の心血管リスク低減用途特許を侵害していないと判断しました。この判決は、後発薬メーカーが特許で保護された特定の効能をラベルから除外している場合、単なる一般的な宣伝活動だけでは「特許侵害の積極的誘発」には当たらないという法的基準を確立したものです。

U.S. Supreme Court Decision in Hikma v. Amarin
On June 4, 2026, the U.S. Supreme Court issued a unanimous 9–0 decision in Hikma Pharmaceuticals USA Inc. v. Amarin Pharma, Inc. (No. 24-889), overturning the judgment of the U.S. Court of Appeals for the Federal Circuit (CAFC) and holding that Hikma’s generic product did not infringe Amarin’s patented method for reducing cardiovascular risk.
The ruling establishes an important legal standard: when a generic drug manufacturer has properly carved out a patented indication from its product labeling, general promotional activities alone are insufficient to constitute “active inducement of patent infringement.” In other words, merely marketing a generic product for its approved non-patented uses does not automatically expose the manufacturer to liability for inducing infringement of a patented use that has been excluded from the label.
