元裁判官で東京大学大学院法学政治学研究科教授の大渕哲也先生の最終講義が3月7日に行われました。知的財産法に関して多く学ばせていただきました。 最終講義も、大渕先生らしさが表れたものでした。 複雑な知財法領域を「法律からスタートし、民事・行政・刑事の各観点を意識して論理を組み立てる」大切さを力説されていました。特に、当事者間の利害調整や実務上の慣行だけで済ませず、「法律としての知的財産法」を踏まえることの重要性を繰り返し強調されていたのが印象的です。 大渕哲也教授の知的財産法における貢献について、Deep Researchで調査しました。ご参照ください。 大渕哲也教授 最終講義 https://www.j.u-tokyo.ac.jp/news/1504/ Intellectual Property Law as Law The final lecture of Professor Tetsuya Obuchi, a former judge and professor at the Graduate Schools for Law and Politics, The University of Tokyo, was held on March 7. It provided significant insights into intellectual property law. Professor Obuchi’s characteristic approach was evident throughout the lecture. He emphasized the importance of starting from the law itself and constructing logical arguments by consciously considering civil, administrative, and criminal perspectives within the complex field of intellectual property law. Particularly impressive was his repeated emphasis on the necessity of grounding intellectual property law discussions firmly in the law itself, rather than solely relying on balancing interests between parties or practical conventions.
