特許出願非公開制度の運用と課題

2024年5月1日に施行された経済安全保障推進法に基づく特許出願の非公開制度は、日本の安全保障を技術的側面から強化する画期的な一歩として注目されています。
この制度は、国の安全を脅かす可能性のある機微な発明が、特許公開を通じて国外に流出することを防ぐことを目的としています。しかし、その運用開始から約1年が経過した現在、制度の運用実態、特に補償基準の曖昧さが、産業界、とりわけ研究開発の最前線に立つ企業や発明者に深刻な懸念と負担をもたらしていることが明らかになってきました。
記事「防衛特許『非公開』運用の衝撃。経産省の補償基準と現場の苦悩」が指摘するように、イノベーションへの萎縮効果や国際競争力の低下といった副作用が危惧されています。

Operation and Challenges of the Patent Application Non-Disclosure System
The patent application non-disclosure system, established under the Economic Security Promotion Act and enforced on May 1, 2024, has attracted attention as a groundbreaking step toward strengthening Japan’s national security from a technological perspective.
This system aims to prevent sensitive inventions that could threaten national security from being disclosed overseas through patent publication. However, approximately one year after its implementation, it has become clear that the actual operation of the system—particularly the ambiguity of compensation standards—has created serious concerns and burdens for industry, especially for companies and inventors at the forefront of research and development.
As pointed out in the article “The Shock of Defense Patent ‘Non-Disclosure’ Operations: METI’s Compensation Standards and the Struggles on the Ground,” there are growing concerns about potential side effects, including a chilling effect on innovation and a decline in international competitiveness.
