最高裁で「発明者は自然人（人間）に限る」が確定

人工知能（AI）が発明したとされる技術の特許出願において、AIを「発明者」と認めるかどうかが争われた訴訟で、最高裁第2小法廷（岡村和美裁判長）は、2026年3月4日付で米国在住の出願者による上告を受理しない決定を下しました。これにより、「発明者は自然人（人間に）に限られる」とした一審・東京地裁および二審・知的財産高裁の判決が確定しました。

In a lawsuit concerning a patent application for a technology allegedly invented by artificial intelligence (AI), the key issue was whether AI could be recognized as an “inventor.” On March 4, 2026, the Second Petty Bench of the Supreme Court (Presiding Justice Kazumi Okamura) issued a decision not to accept the final appeal filed by the U.S.-based applicant. As a result, the rulings of the first instance (Tokyo District Court) and the second instance (Intellectual Property High Court), which held that “inventors are limited to natural persons (human beings),” have become final.
