令和７年（行ケ)第１００２３号審決取消請求事件（令和８年４月１６日判決言渡）は、発明の名称を「熱可塑性樹脂組成物とそれを用いた樹脂成型品および偏光子保護フィルムならびに樹脂成形品の製造方法」とする発明についての特許無効審判請求を不成立とした審決の取消訴訟で、当業者は主引用発明及び文献に記載された技術的事項に基づき、特許発明と主引用発明との相違点に係る構成を採用することを容易に想到することができたものといえ、かつ、当該特許発明は、その構成が奏するものとして当業者が予測することができなかった効果を奏しているとは認められないとして、特許無効審判請求を不成立とした審決を取り消した事例です。
