「除くクレーム」審査基準の明確化が検討中

1月19日特許庁ホームページに新着情報が掲載されました。
「「除くクレーム」とする補正について」を更新しました
その内容をみると、下記のような内容でした。
『「除くクレーム」とする補正がなされた案件について、ユーザーの皆様からは、適切な審査を求める声を多く頂いております。これを踏まえて、特許庁では、審査の適正化を図り、審査の質の向上に努めているところです。
また、第18回審査基準専門委員会ワーキンググループにおいて、「除くクレーム」とする補正がなされた場合の考え方について審議され、審査基準の明確化が検討されています。

出来るだけ早く実現してほしいものです。
第18回審査基準専門委員会ワーキンググループの検討内容をNotebookLMにまとめさせました。また、「知財実務オンライン」での指摘や「そーとく日記」における論考との関係を生成AIに整理させました。

Clarification of Examination Guidelines for “Disclaimer Claims” Under Consideration
On January 19, new information was posted on the Japan Patent Office (JPO) website.
The page titled “Regarding Amendments in the Form of ‘Disclaimer Claims’” was updated.
According to the update, the content was as follows:
“With respect to cases in which amendments in the form of ‘disclaimer claims’ have been made, we have received many requests from users calling for appropriate examination. In response, the Japan Patent Office is working to ensure the appropriateness of examinations and to improve the quality of examination.
In addition, at the 18th Meeting of the Examination Guidelines Expert Committee Working Group, discussions were held on the approach to cases involving amendments in the form of ‘disclaimer claims,’ and clarification of the examination guidelines is currently under consideration.

I hope that this will be implemented as soon as possible.
