衆議院議員選挙自民党圧勝の企業知財戦略への影響

2026年2月8日の衆議院議員選挙における自民党の圧勝は、高市政権に極めて強力な政治基盤をもたらし、経済安全保障を中核に据えた政策パッケージの迅速かつ強力な実行を可能にしました。
高市政権は、「サナエノミクス」の下で「危機管理投資」と「成長投資」をますます加速させるでしょう。特に、経済安全保障推進法の改正やセキュリティ・クリアランス制度の厳格な運用を通じて、AI、量子、宇宙等の特定重要技術分野における国家主導の研究開発と管理体制を強化します。これにより、企業は政府の大型プロジェクトへの参画機会を得る一方で、特許出願非公開制度や厳格化する輸出管理規制といった新たな制約に直面します。
この状況は、企業の知財戦略に根本的な見直しを迫ります。従来のオープンイノベーション一辺倒の戦略は通用せず、技術の特性に応じて「オープン」と「クローズ」を使い分ける、より緻密なオープン・クローズ戦略の再構築が不可欠となります。また、サプライチェーンの寸断、技術流出、コンプライアンス違反といった経済安全保障リスクは、もはや法務部門の課題ではなく、経営レベルで取り組むべき事業継続上の重要リスクとして認識されなければなりません。
企業は、政府資金を活用した研究開発を推進する一方で、成果物の知財に関する厳格な契約条項を遵守する必要があります。企業は知的財産を単なる「権利」ではなく、事業と国家安全保障の双方に貢献する「戦略資産」と位置づけ、経営の中核に据えることが求められます。
①経済安保コンプライアンス体制の確立(守り)、②戦略的知財ポートフォリオの構築(攻め)、③国内外の政策・技術動向を分析するインテリジェンス機能の強化(攻守両面)という3つの柱を統合した、統合的知財戦略の策定と実行が、今後の持続的な成長の鍵を握ることになります。

Impact of the LDP’s Landslide Victory in the House of Representatives Election on Corporate IP Strategy
The Liberal Democratic Party’s landslide victory in the House of Representatives election on February 8, 2026, has provided the Takayichi administration with an exceptionally strong political mandate, enabling the swift and forceful implementation of a policy package centered on economic security.
Under “Sanaenomics,” the Takayichi administration is expected to further accelerate both “crisis-management investment” and “growth investment.” In particular, through amendments to the Economic Security Promotion Act and the strict operation of the security-clearance system, the government will strengthen state-led research and development and governance frameworks in designated critical technology fields such as AI, quantum technologies, and space. As a result, while companies will gain opportunities to participate in large-scale government projects, they will also face new constraints, including the non-publication system for patent applications and increasingly stringent export-control regulations.
These developments compel a fundamental reassessment of corporate intellectual property strategies. A one-sided reliance on open innovation is no longer viable; instead, companies must rebuild more sophisticated open-and-close strategies that selectively balance openness and secrecy according to the nature of each technology. Moreover, economic security risks—such as supply-chain disruptions, technology leakage, and compliance violations—must no longer be treated as mere legal or compliance issues. They must be recognized as critical business-continuity risks to be addressed at the management level.
While promoting R&D through government funding, companies must also strictly comply with contractual provisions governing the intellectual property arising from such projects. Intellectual property should no longer be viewed merely as a set of “rights,” but rather positioned as a “strategic asset” that contributes simultaneously to business competitiveness and national security, and placed at the core of corporate management.
The key to sustainable growth going forward will be the formulation and execution of an integrated intellectual property strategy that unifies three pillars:
(1) the establishment of an economic security compliance framework (defense),
(2) the construction of a strategic IP portfolio (offense), and
(3) the strengthening of intelligence capabilities to analyze domestic and international policy and technological trends (both offense and defense).
