Case Nos. 10093 and 10094 (Gyo-Ke), 2023 – Use Inventions
On September 9, attorney-at-law and patent attorney Hideki Takaishi (Nakamura & Partners) from the IP Practice Information Lab. Expert Team posted an article titled: “A case holding that for a cited invention to be recognized as a (pharmaceutical) use invention, it is insufficient that only preliminary tests provide merely reference-level data showing promising results.”
This article is a commentary on the Intellectual Property High Court’s decision in Case Nos. 10093 and 10094 (Gyo-Ke), 2023, known as the Movement Disorder Therapeutic Agent Case (presided over by Judge Miyasaka). The commentary clearly illustrates—along with references to related precedents—that when the claimed use of a pharmaceutical use invention is novel, the hurdle for denying inventive step is quite high.
