発明者ヒアリングは、特許出願の成否を握る重要なプロセスです。弁理士や知財担当者は、単なる情報の聞き取りにとどまらず、発明の本質を抽出して「共創」するファシリテーターとしての役割が求められています。
ヒアリングの質を高めるためには、事前準備での仮説構築や、発明者の心理的安全性を確保する対話技術、先行技術との差別化を図る戦略的質問が不可欠で、権利範囲の最大化や侵害発見の容易性を考慮した法的設計が求められます。さらに、これらのプロセスを通じてビジネス価値の高い「強い特許」を構築することが重要です。
発明者と協働して「強い権利を創出」するために、弁理士や知財部員が発明者にヒアリングを行う際の実践的かつ戦略的なポイントについて、生成AIにまとめさせました。さらに、結果をNotebookLMでインフォグラフィック、スライド資料にさせました。

Inventor Interviews
Inventor interviews are a critical process that can determine the success or failure of a patent application. Patent attorneys and IP professionals are expected not merely to collect information, but to act as facilitators who extract the essence of the invention and “co-create” it together with the inventor.
To enhance the quality of interviews, it is essential to engage in hypothesis building during the preparation stage, employ dialogue techniques that ensure the inventor’s psychological safety, and ask strategic questions that clearly differentiate the invention from prior art. In addition, legal design that takes into account maximization of claim scope and ease of detecting infringement is required. Through these processes, it is important to build “strong patents” with high business value.
With the aim of “creating strong rights” through collaboration with inventors, generative AI was used to compile practical and strategic points for patent attorneys and IP department members to consider when conducting inventor interviews. The results were further developed into infographics and slide materials using NotebookLM.
