令和４年（ワ）第２３８８号損害賠償等請求事件は、出版社である原告らが、被告（クラウドフレアCloudflare社）に対し、原告らが出版権を有する漫画の複製データが海賊版サイトから配信された際に、被告がコンテンツ・デリバリー・ネットワークサービスを提供したことにより、原告らの出版権（公衆送信権）が侵害されたと主張して、各原告に対し、不法行為（主位的に民法７０９条、予備的に同法７１９条２項）に基づく損害賠償金の支払を求めた事案です。
クラウドフレア社が、著作権を侵害している海賊版サイト運営者に対しCDNサービスを提供したことが、著作権侵害の幇助にあたるか否かなどが争点でした。
2025年年11月19日に東京地方裁判所で判決が言い渡され、特定の条件下では被告（クラウドフレア社）が著作権侵害を回避する義務を負っていたと認定し、原告（出版社など）側の主張の一部を認めました。
この判決は、インターネット上のプラットフォーム事業者やCDN事業者の責任の範囲を示すものとして、重要な先例となる可能性があります。

Judgment in Case No. 2022 (Wa) 2388: Copyright Infringement Lawsuit
Case No. 2022 (Wa) 2388, a claim for damages and other relief, concerns a lawsuit filed by the plaintiffs—publishers—against the defendant, Cloudflare, Inc. The plaintiffs alleged that when digital copies of manga works for which they hold publication rights were distributed through a piracy website, the defendant infringed their publication rights (specifically, the right of public transmission) by providing its content delivery network (CDN) services. Each plaintiff sought damages based on tort liability (primarily under Article 709 of the Civil Code, and alternatively under Article 719(2)).
The main issues in dispute included whether Cloudflare's provision of CDN services to the operators of piracy websites that infringed copyright constituted contributory copyright infringement.
On November 19, 2025, the Tokyo District Court handed down its judgment. The court found that under certain conditions, the defendant (Cloudflare) had a duty to take measures to avoid copyright infringement and recognized part of the plaintiffs’ (publishers’) claims.
This judgment may become an important precedent, as it clarifies the scope of liability for online platform operators and CDN providers.
