医薬品用途発明と食品用途発明

最近の知財高裁判決により、医薬用途発明の用途が新しい場合に進歩性を否定することの高いハードルが改めて認識されてきています。
それに比べて、食品用途発明では、そのハードルは低いと感じています。
医薬品と食品の用途発明の共通点と相違点を、生成AIに、分かりやすく整理して説明するよう指示して報告させました。

Pharmaceutical Use Inventions and Food Use Inventions
Recent rulings by the Intellectual Property High Court have once again highlighted the high hurdle in denying inventive step when the claimed use of a pharmaceutical invention is new.
In comparison, I feel that this hurdle is lower in the case of food-use inventions.
I instructed generative AI to clearly organize and explain the similarities and differences between pharmaceutical use inventions and food use inventions, and had it report the findings.
