サポート要件(審判実務者研究会報告書2025)

特許庁審判部が公表した「審判実務者研究会報告書2025」における事例研究１テーマ３（特許化学）「サポート要件」では、以下の２つの論点が議論されています。
論点１：本件発明のクレーム範囲をカバーする実施例が不足している場合、サポート要件適否判断において重要となる事項は何か
論点２：技術常識などを考慮してもサポート要件が充足されないとする分水嶺はどこなのか

Support Requirement
In the case study “Theme 3 (Chemistry): Support Requirement” from the Trial Practitioners Study Group Report 2025 published by the Trial and Appeal Department of the Japan Patent Office, the following two issues are discussed:
Issue 1: When there are insufficient examples covering the full scope of the claimed invention, what factors are important in determining whether the support requirement is satisfied?
Issue 2: Even when taking common general technical knowledge into account, where is the threshold at which the support requirement is deemed not to be satisfied?
