という典型的な除くクレーム特許で、同じ原出願からの分割出願において、特許請求の範囲に「全量に対して０～１０体積％の界面活性剤」を含む旨の記載があるので、本件特許の「（但し、界面活性剤が全量に対して０～１０体積％であるものを除く。）」という記載は、当該「他の出願」とのダブルパテントを解消するために補正で追加されたものです。

One or more hydrocarbons selected from the group consisting of limonene, squalene, and squalane, in an amount greater than their solubility in water,
Surfactants (provided that the surfactants constitute 0 to 10 volume percent of the total composition),
which characterizes this as a typical excluding claim patent. In a divisional application from the same original application, there is a statement in the scope of claims that includes '0 to 10 volume percent of surfactants relative to the total amount,' thus, the statement in this patent, '(provided that the surfactants constitute 0 to 10 volume percent of the total composition),' was added during amendment to eliminate double patenting with the 'other application.'
As mentioned in the comment section of 'Ataka Shiro's Intellectual Property Commentary Channel,' it is puzzling why this was granted as a patent.
