祝・訴訟終結記念!生成AI特許訴訟の解説セミナー

サマリア(Summaria)を提供しているパテント・インテグレーション株式会社が 「Patentfield AIR」を提供しているPatentfield 株式会社に対し、提起していた特許権侵害訴訟が終了しましたが、それを祝した「祝・訴訟終結記念!生成AI特許訴訟の解説セミナー」が5月13日に東京で行われ聴講しました。
セミナーでは、MASSパートナーズ法律事務所 郡佑太弁護士から「パテント・インテグレーション訴訟を素材に読み解く訴訟・知財実務の勘所」という講演が行われました。郡弁護士は、本訴訟に関与していないため、裁判所に出向いてすべての書類を閲覧し訴訟の全体像を把握したそうです。技術説明会が行われたこと、技術説明会で裁判所が特に説明を求めた事項なども含め、訴訟の全容がかなり理解できました。
本訴訟は、「民事調停法 17 条に基づく調停に代わる決定」の確定による終了となりましたので、公開されていない「調停決定」の内容が気になったところでしたが、郡弁護士が全文パソコンに打ち込んだという事で紹介されました。一部黒塗りのところ(閲覧制限対象部分)を含め、全文を見ることが出来ました。
まとめの「パテント・インテグレーション訴訟から読み解く、生成Al時代の知財実務の勘所」では、分割出願を活用した戦略的訴訟提起と、差止・損害賠償の分離提訴、生成A l分野における「技術常識」「当業者」の設定は慎重な検討が必要、が参考になりました。

In that sense, the event was a clear declaration of this transition. NTTら、AIロボットと次世代通信で工場点検を高度化

NTTグループ、1Finity、三菱ケミカルの3者は、2026年2月、岡山県の水島臨海工業地帯(水島コンビナート)において、次世代通信基盤「IOWN(Innovative Optical and Wireless Network)」の「All-Photonics Network(APN)」と60GHz帯無線LAN「WiGig」を組み合わせた大容量・低遅延通信環境を構築し、当該通信環境を用いて、自律型ロボットやデジタルツインなどのフィジカルAI技術を活用した屋外設備点検の高度化に関する検証を実施し、リアルタイムで大量のデータ収集が可能であることを確認したという発表を行いました。

NTT and Partners Advance Industrial Facility Inspection with AI Robots and Next-Generation Communications
In February 2026, three organizations--NTT Group, 1Finity, and Mitsubishi Chemical Group—conducted a demonstration at the Mizushima Coastal Industrial Zone (Mizushima Petrochemical Complex) in Okayama Prefecture. They established a high-capacity, low-latency communications environment by combining the All-Photonics Network (APN) of the next-generation communications infrastructure IOWN (Innovative Optical and Wireless Network) with 60 GHz-band wireless LAN technology (WiGig).
Using this communications environment, they carried out a verification study aimed at enhancing outdoor facility inspection through the application of Physical AI technologies, including autonomous robots and digital twins. The demonstration confirmed that large volumes of data can be collected and transmitted in real time.

2026年6月1日、NVIDIAはGTC Taipei 2026においてWindows PC向けSoC「RTX Spark」を発表しました。TSMCの3nmプロセスで製造され、20コアArmベースのGrace CPUとBlackwell世代GPUを統合したこのチップは、最大128GBのユニファイドメモリと最大1ペタフロップのAI演算性能を備え、1,200億パラメータ規模のLLMを最大100万トークンのコンテキストでローカル実行することを可能にします。ASUS、Dell、HP、Lenovo、Microsoft Surface、MSIなどの主要メーカーから2026年秋に搭載PCが発売予定です。
この技術的飛躍は、知財業務においてこれまでクラウドAPIへのデータ送信という根本的障壁に阻まれてきたAI活用を、セキュアなローカル環境で実現する転換点となることでしょう。機密性の高い未公開発明情報を扱う知財部門にとって、影響は業務効率化の次元を超え、知財戦略の構造変革に及ぶ可能性があると思われます。

Transformation of Intellectual Property Practice through Local LLM
On June 1, 2026, NVIDIA announced “RTX Spark,” an SoC for Windows PCs, at GTC Taipei 2026. Manufactured using TSMC’s 3nm process, the chip integrates a 20-core Arm-based Grace CPU with a Blackwell-generation GPU. It features up to 128GB of unified memory and up to 1 petaflop of AI computing performance, enabling LLMs with up to 120 billion parameters to run locally with a context length of up to 1 million tokens. PCs equipped with the chip are scheduled to be released in autumn 2026 by major manufacturers including ASUS, Dell, HP, Lenovo, Microsoft Surface, and MSI.
This technological leap is likely to become a turning point for the use of AI in intellectual property work, making it possible to deploy AI in a secure local environment—something that has until now been fundamentally constrained by the need to send data to cloud APIs. For IP departments handling highly confidential, unpublished invention information, the impact may go beyond improved operational efficiency and extend to a structural transformation of IP strategy itself.

令和7年(行ケ)第10019号 CRISPR-Cas9中核特許優先権承継事件

令和7年(行ケ)第10019号審決取消請求事件は、CRISPR-Cas9ゲノム編集技術の中核特許をめぐる国際的紛争で、パリ条約4条A(1)にいう「承継人(successor in title)」該当性が正面から争われた審決取消訴訟で、原告らが承継人に当たることを否定して優先権主張を認めず、新規性及び進歩性を否定して特許を無効とした審決の判断は違法であるとしてこれを取り消した事例です。
優先権承継の成否は、従来の日本の実務では、承継を証明する書面の有無を基軸とする形式的・書面ベースで判断されてきましたが、本判決は、譲渡書面という直接証拠の不存在のみを理由に承継を否定した審決を取り消し、ロックフェラー大学から原告ブロード研への「黙示の優先権譲渡」が本件PCT出願時点で成立していたと認定しました。

The case of Intellectual Property High Court Case No. 2025 (Gyo-Ke) 10019, an action seeking rescission of a JPO trial decision, concerned an international dispute over a core patent relating to CRISPR-Cas9 genome-editing technology. The central issue was whether the plaintiffs qualified as a “successor in title” under Article 4A(1) of the Paris Convention.
The Intellectual Property High Court held that the JPO trial decision, which had denied the plaintiffs’ priority claim on the grounds that they were not successors in title and consequently invalidated the patent for lack of novelty and inventive step, was unlawful and should be rescinded.
Traditionally, Japanese practice regarding the succession of priority rights has tended to rely on a formal, document-based approach, focusing primarily on the existence or absence of written evidence demonstrating the transfer of rights. In this judgment, however, the court overturned the JPO’s conclusion, which had denied succession solely because no direct documentary evidence of assignment existed. Instead, the court found that an “implied assignment of priority rights” from Rockefeller University to the Broad Institute had already been established by the time the relevant PCT application was filed.

On May 28, 2026, Anthropic officially released Claude Opus 4.8, the latest version of its flagship model. Arriving just about one month after Opus 4.7 (released in April 2026), the new model delivers broad improvements across coding, reasoning, agentic workflows, and knowledge-intensive tasks.
According to the Intelligence Index published by the independent evaluation organization Artificial Analysis, Opus 4.8 achieved a score of 61.4, surpassing GPT-5.5 (xhigh) by 1.2 points and claiming the top overall position. (However, in terminal-based coding benchmarks such as Terminal-Bench, GPT-5.5 still maintains a slight advantage, scoring 78.2%.)

2026年5 月28 日に開催されたLexisNexis PatentSight+ Summit 2026では、株式会社荏原製作所 技術経営戦略統括部 知的財産部 高栁 秀樹 部長が、「知財ROICによる知財経営の高度化:荏原製作所における知財ガバナンスと価値評価の実践」というタイトルで、多様な業態を持つ荏原製作所の知財ガバナンスを紹介。管理会計的思考に基づき、知財活動の「質」を定量化する「知財ROIC」の取り組みを解説。また、独自の発明評価と事業特性に合わせた評価の個別最適(レトロフィット)や、同指標を用いた経営層との対話の 深化など、最前線の実務について紹介しました。その内容は、後日、記事として提供されるということです。

At the LexisNexis PatentSight+ Summit 2026, held on May 28, 2026, Hideki Takayanagi, General Manager of the Intellectual Property Department, Technology Management Strategy Division, Ebara Corporation, delivered a presentation titled:
“Advancing Intellectual Property Management through IP ROIC: Ebara Corporation’s Practices in IP Governance and Value Assessment.”
In this presentation, Mr. Takayanagi introduced Ebara Corporation’s intellectual property governance framework, which supports the company’s diverse business portfolio. He explained the company’s efforts to quantify the quality of intellectual property activities through an IP ROIC (Return on Invested Capital) approach grounded in management accounting principles.
He also discussed cutting-edge practices, including Ebara’s proprietary invention evaluation methodology, the customized optimization (“retrofit”) of evaluation criteria to reflect the characteristics of individual businesses, and the deepening of dialogue with senior management through the use of this metric. According to the presentation, the details will be published in article form at a later date.

令和7年(行ケ)第10023号審決取消請求事件(令和8年4月16日判決言渡)は、発明の名称を「熱可塑性樹脂組成物とそれを用いた樹脂成型品および偏光子保護フィルムならびに樹脂成形品の製造方法」とする発明についての特許無効審判請求を不成立とした審決の取消訴訟で、当業者は主引用発明及び文献に記載された技術的事項に基づき、特許発明と主引用発明との相違点に係る構成を採用することを容易に想到することができたものといえ、かつ、当該特許発明は、その構成が奏するものとして当業者が予測することができなかった効果を奏しているとは認められないとして、特許無効審判請求を不成立とした審決を取り消した事例です。

Reiwa 7 (Gyo-ke) No. 10023, a case seeking rescission of a trial decision (judgment rendered on April 16, Reiwa 8), concerned a request for a patent invalidation trial regarding an invention entitled “Thermoplastic Resin Composition, Resin Molded Article and Polarizer Protective Film Using the Same, and Method for Manufacturing a Resin Molded Article.”
In this case, the court held that a person skilled in the art could have easily conceived of adopting the configuration relating to the differences between the patented invention and the primary cited invention, based on the primary cited invention and the technical matters described in the cited documents. The court also found that the patented invention could not be recognized as producing an effect that a person skilled in the art could not have predicted as resulting from its configuration. Accordingly, the court revoked the trial decision that had found the request for a patent invalidation trial to be groundless.

令和7年(行ケ)第10043号審決取消請求事件(令和8年3月26日判決言渡)は、相違点の容易想到性の判断及び予測できない顕著な効果の判断に誤りがあるとして、審決を取り消した事例です。
原告は、名称を「光拡散層形成用塗料、プロジェクションスクリーン用フィルム、及びプロジェクションスクリーン」とする発明につき特許出願(特願2019-20111 3号。本願)をしたが、拒絶査定(本件拒絶査定)を受け、不服の審判請求をしました。これに対し特許庁は、「本件審判の請求は、成り立たない。」との審決(本件審決)をしたので、原告は、本件訴訟を提起しました。
原告が主張した取消事由は、取消事由1(「樹脂」の種類に関する引用発明の認定の誤り)、取消事由2(「用途」に関する引用発明の認定の誤り)、取消事由3( 相違点の容易想到性判断の誤り)、取消事由4( 予測できない顕著な効果の判断の誤り)及び取消事由5( 審判手続の瑕疵) でした。
本判決は、原告の主張する取消事由1及び2には理由がないが、以下のとおり、取消事由3及び4の各一部には理由があるとして、本件審決を取り消しました。

The case of Reiwa 7 (Gyo-Ke) No. 10043, an action seeking rescission of a JPO trial decision (judgment rendered on March 26, Reiwa 8 [2026]), is a case in which the court rescinded the JPO decision on the grounds that there were errors in the determination of the obviousness of the differences and in the assessment of unpredictable and remarkable effects.
The plaintiff filed a patent application (Japanese Patent Application No. 2019-201113; the “Application”) for an invention entitled “Coating Material for Forming a Light Diffusion Layer, Projection Screen Film, and Projection Screen.” However, after receiving a decision of refusal (the “Refusal Decision”), the plaintiff filed an appeal against the examiner’s decision. In response, the Japan Patent Office rendered a trial decision stating that “the request for appeal in this case is groundless” (the “JPO Decision”). The plaintiff therefore instituted the present action.
The grounds for rescission asserted by the plaintiff were:
(1) Ground 1: Error in the identification of the cited invention regarding the type of “resin”;
(2) Ground 2: Error in the identification of the cited invention regarding the “use”;
(3) Ground 3: Error in the determination of the obviousness of the differences;
(4) Ground 4: Error in the determination regarding unpredictable and remarkable effects; and
(5) Ground 5: Defect in the trial proceedings.
In this judgment, the court held that Grounds 1 and 2 asserted by the plaintiff were without merit. However, the court found that portions of Grounds 3 and 4 were well-founded for the reasons described below, and accordingly rescinded the JPO Decision.

2026年5月22日の読売新聞に『知的財産を企業の「稼ぐ力」に、コンテンツ産業への公的投資「5年で5000億円以上」に拡大求める…自民知財戦略調査会が提言案』という記事がありました。自民党知的財産戦略調査会がまとめた知財戦略の提言案で近く政府に提出され、6月に取りまとめられる「知財推進計画2026」に反映されると考えられます。
