特許においても、ChatGPTとの壁打ちでわずかな時間で大量のアイデアを創出・発展させ大量の特許出願を行う企業が現れています。それらを特許出願せずに公開することも考えられます。
生成AIの進化は、特許審査における「新規性」判断そのものの法的基準を直接変えるわけではありませんが、生成AIの普及とそれに伴う技術情報やドキュメントの爆発的増加は、以下のような間接的・実務的な影響を与える可能性があります。
 
1. 先行技術の増大による検索範囲の拡大
大量のAI生成コンテンツが“公開文献”として扱われる

• 生成AIを利用して作成された論文、記事、コード、画像などが公開されれば、それらは「先行技術文献」として参照される可能性があります。
• 従来であれば人間が執筆・作成していた文献の数がある程度限られていましたが、AIにより自動的に量産されるコンテンツが増加することにより、新規性調査で検索すべき対象が飛躍的に増えます。
