AI時代の知的財産権検討会（第８回）の今後の議論に期待

10月24日に内閣府知的財産戦略本部の「AI時代の知的財産検討会」が1年半ぶりに開催されました。「AI時代の知的財産権検討会（第８回）」になります。
この間の生成AIの進化は驚くほどで、委員の方々から一部は話されていますが、その状況を正確に把握すべきという意見はその通りだと思います。諸外国に比べてAI活用が遅れている現状を変え、AIを活用しやすい環境を整えていただきたいものです。
事務局が提示した論点例は、下記の通りです。今後の議論に期待。

データの収集や、生成 AI に係る開示・表示、保護データに係る対価還元、保護データに係る侵害防止技術、海賊版・偽情報・誤情報のスクリーニングに係る技術など、データの信頼性・安全性を含め生成 AI に係る開示に向けた各種の対応が必要と考えられるところ、どのような方向で検討を進めるべきか。
【論点②】
法・技術・契約の各手段を適切に組み合わせながら、連携した取組が重要であるところ、データ利活用に伴う対価還元を進めていくため、どのような課題を特定しつつ、取組を進めていくべきか。
【論点③】
直近の生成 AI と知的財産をめぐる技術動向や、国内外の裁判例等も踏まえつつ、AI とデータの取扱いについて、どのような将来像を想定しておくべきか。

Looking Forward to Future Discussions at the 8th Meeting of the AI Era Intellectual Property Rights Review Panel
On October 24, the Cabinet Office’s Intellectual Property Strategy Headquarters held the “Study Group on Intellectual Property in the AI Era” for the first time in a year and a half. This marks the 8th session of the “Study Group on Intellectual Property Rights in the AI Era.”
The evolution of generative AI during this period has been astonishing. Some of the committee members have already touched upon this, but I fully agree with the view that we must accurately grasp the current state of AI. I sincerely hope that Japan will overcome its current lag in AI utilization compared to other countries and that an environment conducive to effective AI use will be established.

Given the need to address various aspects related to the disclosure of generative AI—including data collection; disclosure and labeling related to generative AI; mechanisms for fair compensation concerning protected data; technologies for preventing infringement of protected data; and technologies for screening pirated, false, or misleading information, as well as ensuring the reliability and security of data—what direction should future discussions take?

Recognizing the importance of coordinated efforts that appropriately combine legal, technical, and contractual measures, what issues should be identified, and how should initiatives be advanced to promote fair compensation and value return associated with data utilization?
[Point 3]
Taking into account recent technological developments in generative AI and intellectual property, as well as relevant domestic and international court decisions, what kind of future vision should be envisaged regarding the handling of AI and data?
