The progress of generative AI and simulation technologies raises significant questions for invention creation and the patent system. In response, the Institute of Intellectual Property conducted a study commissioned by the Japan Patent Office titled “Approaches to Protecting Inventions in Light of Advances in AI Technology.” The study organized key issues such as the definition of invention, the treatment of AI-generated outputs, the assessment of novelty and inventive step, and description requirements. While the report denies the need for immediate legislative amendments, it emphasizes the importance of developing guidelines and establishing an AI-assisted examination support framework.
