「除くクレーム」補正の考え方

2025年11月17日に開催された産業構造審議会知的財産分科会特許制度小委員会第18回審査基準専門委員会ワーキンググループの会議では、主要な議題として、AI関連発明の審査に関する最近の取り組みが報告され、審査基準の改訂を予定している四つの重要事項が挙げられました。
特に「除くクレーム」とする補正の考え方については、その濫用や審査における予見性の問題が指摘されており、進歩性、新規事項の追加、および明確性要件の観点から、審査基準の明確化を図る具体的な方向性が議論されました。
議事録も公表されましたので、関連資料と共にNotebookLMにアップロードし、これをソースとして、レポート、インフォグラフィック、スライド資料を作成させました。

Concept of Amendments Using “Exclusion Claims”
At the 18th meeting of the Examination Standards Expert Working Group of the Patent System Subcommittee, Intellectual Property Committee, Industrial Structure Council—held on November 17, 2025—the latest initiatives on the examination of AI-related inventions were reported as a major agenda item. Four important issues were presented for which revisions to the Examination Guidelines are scheduled.
In particular, regarding the concept of amendments employing “exclusion claims,” concerns were raised about potential misuse and issues of predictability in examination. The discussion focused on specific directions for clarifying the Examination Guidelines from the perspectives of inventive step, addition of new matter, and the clarity requirement.
