令和６年(行ケ)第１０１００号　誤訳の訂正

令和６年(行ケ)第１０１００号判決(2025年10月8日)は、無効審判請求事件においてなされた訂正請求が、誤訳の訂正に当たらず、訂正は認められるべきではないとして、訂正を認め無効審判請求を不成立とした審決を取り消した事例です。

Case No. 2024 (Gyo-Ke) 10100: Correction of Translation Errors
In Case No. 2024 (Gyo-Ke) 10100, decided on October 8, 2025, the Intellectual Property High Court held that a correction request made in an invalidation trial did not qualify as a “correction of a mistranslation.” The Court therefore annulled the JPO’s decision that had allowed the correction and dismissed the invalidation request.
In the invalidation trial concerning Patent No. 6328108, the patentee requested a “correction of translation error” to amend the English word “linear,” which had been translated as “直線的” (“linear”), to “直接的” (“direct”). The IP High Court determined that this amendment did not satisfy the statutory requirements for a correction of mistranslation under the Patent Act. Consequently, the JPO’s decision recognizing the correction—and thereby rejecting the invalidation request—was revoked.
