Case No. (Ne) 10086 of 2024: Appeal Case for Injunction, etc. Based on Design Right Infringement
The judgment in Case No. (Ne) 10086 of 2024, Appeal Case for Injunction, etc. Based on Design Right Infringement (original instance: Tokyo District Court Case No. (Wa) 20229 of 2021), was rendered on June 26, 2025.
This case involved a claim for an injunction, etc., based on a design right for an article described as a “storage container.” The Intellectual Property High Court held that the design of the defendant’s product was not similar to the plaintiff’s registered design.
In the first instance (Tokyo District Court judgment of October 30, 2024), the court determined that the allegedly infringing design (defendant’s design) was similar to the plaintiff’s registered design, and thus granted the injunction and other relief sought.
However, in the appeal judgment, the IP High Court reached the opposite conclusion—that the two designs were not similar—thereby reversing the lower court’s ruling.
This case has attracted attention because the IP High Court reached a different conclusion from the trial court regarding the similarity of designs.
