ユニクロが不正競争防止法でSHEINを提訴

ユニクロは、SHEINブランドを展開するRoadget Business Pte. Ltd.、Fashion Choice Pte. Ltd.およびSHEIN JAPAN株式会社がユニクロの商品である「ラウンドミニショルダーバッグ」の形態を模倣した商品（以下、模倣商品）を販売する行為等につき、不正競争防止法違反を理由として、2023年12月28日付で、上記3社を相手として、東京地方裁判所に、模倣商品の販売の停止と、販売によりユニクロが被った損害の賠償を求める訴訟等の申立てを行いました。
今回の申立ては、SHEINが販売する模倣商品の形態がユニクロ商品の形態に酷似しており、SHEINによる模倣商品の販売が、ユニクロブランドおよびユニクロの商品の品質に対するお客様からの高い信頼を大きく損ねていると判断したため行ったものということです。
これに対して、SHEINは「他者の知的財産権を尊重し、全ての申し立てを真摯に受け止める。現在、この件について調査中だ」とのコメントを公表しているようです。
SHEINは、ネット販売専門で服やバッグを数百円など極めて安い価格で販売しており、今年中にもアメリカで上場するとみられ、SHEINの時価総額は、ユニクロ、ZARAを超えている可能性もあるということです。ユニクロの危機感は相当なものでしょう。
不正競争防止法で勝ち切るのはかなりむずかしいとは思いますが、今後に注目したいと思います。

UNIQLO Files Lawsuit Against SHEIN Under the Unfair Competition Prevention Act
 
Uniqlo filed a lawsuit against Roadget Business Pte. Ltd., Fashion Choice Pte. Ltd., and SHEIN JAPAN Co., Ltd., the companies behind the SHEIN brand, at the Tokyo District Court on December 28. The lawsuit alleges violations of the Unfair Competition Prevention Act for selling products that imitate the shape of Uniqlo's "Round Mini Shoulder Bag" (hereinafter referred to as "imitation products"). The lawsuit seeks an injunction to stop the sale of the imitation products and compensation for damages caused to Uniqlo by the sale of these products.
 
The lawsuit was filed because the shape of the imitation products sold by SHEIN bears a striking resemblance to Uniqlo's product, and it is believed that the sale of SHEIN's imitation products could significantly damage the high level of trust that customers have in the Uniqlo brand and the quality of Uniqlo's products.
 
In response, SHEIN released a statement saying, "We respect the intellectual property rights of others and take all claims seriously. We are currently investigating the matter."
 
SHEIN, which specializes in online sales, offers clothes and bags at extremely low prices, such as a few hundred yen, and is expected to go public in the United States later this year. There is speculation that SHEIN's market capitalization could potentially exceed that of Uniqlo and ZARA, indicating a significant level of concern for Uniqlo.
 
Winning a case under the Unfair Competition Prevention Act is expected to be quite challenging, but it will be interesting to see how this develops.
