AI技術の発達を踏まえた特許制度上の適切な対応

1月17日に 産業構造審議会知的財産分科会 第51回特許制度小委員会 が開かれました。
議事次第は、
１．DX時代にふさわしい産業財産権手続に関する制度的措置について
２．AI技術の発達を踏まえた特許制度上の適切な対応について
３．国際的な事業活動におけるネットワーク関連発明等の適切な権利保護について
４．その他報告事項について
で、配布資料が特許庁のホームページにアップされています。
 
AI技術の発達を踏まえた検討課題及びこれに対する制度的措置の方向性については、本格的な議論は次回の小委員会（第52回）を予定しており、議論はなく、「AI技術が日進月歩で発展しているなか、数十年先を見込んだ議論が必要だ」といった指摘がありました。「将来的な発明の保護の在り方に関する課題・対応策等を分析する」と言いながら、これまでの対応は後手に廻っているという指摘もあり、先手を打った対応を期待しています。

Appropriate Responses in the Patent System in Light of the Development of AI Technology
 
The 51st meeting of the Patent System Subcommittee of the Intellectual Property Subcommittee of the Industrial Structure Council was held on January 17.
The agenda was as follows
1. Institutional measures on intellectual property rights procedures suitable for the DX era
2. Appropriate responses in the patent system based on the development of AI technology
3. Adequate protection of rights for network-related inventions, etc. in international business activities
4. Other matters to be reported

Regarding the issues to be considered in light of the development of AI technology and the direction of institutional measures in response to these issues, there was no discussion and it was pointed out that "in the midst of the rapid development of AI technology, it is necessary to have discussions that look decades into the future". While it was said that "the issues and countermeasures regarding the future protection of inventions will be analyzed," it was also pointed out that the responses so far have been reactive, and I look forward to proactive responses.
