AIと著作権に関する考え方について（素案）令和6年2月29日時点版

文化庁が1月23日から2月12日にかけて募集した「AIと著作権に関する考え方について（素案）」に関するパブリックコメントに2万4938件という非常に多い意見が集まったということで、関心の高さが示されています。
文化審議会著作権分科会法制度小委員会（第7回）で、パブリックコメントの意見を踏まえた新たな素案も公開されました。委員会では、資料2-2「AIと著作権に関する考え方について（素案）令和6年2月29日時点版（見え消し）」で、変更部分が説明されました。
現行法の解釈で一定程度の歯止めをかけ、AI開発と権利保護の両立を狙う考えです。
諸外国の事例や技術の進展などを踏まえ、引き続き規制のあり方を検討していく必要があるとしていますが、現在進行中の、令和5年度調査研究「AIと著作権に関する諸外国調査」（調査趣旨：AIをめぐる著作権法上の課題等に対応した制度を検討するための基礎資料とするべく、諸外国のAIと著作権に関する調査研究を実施。委託先：三菱UFJリサーチ＆コンサルティング株式会社、調査期間：令和5年8月22日～令和6年3月29日、調査対象国・地域：EU、仏国、独国、英国、米国、中国、シンガポール、調査方法：文献・インターネット調査、有識者ヒアリング）の結果が反映されることが望まれます。

Thoughts on AI and Copyright (Draft) as of February 29, Year 6 of Reiwa
 
The Agency for Cultural Affairs reported that it received an exceptionally high number of public comments, totaling 24,938, in response to the call for comments on the draft 'Thoughts on AI and Copyright' from January 23 to February 12, indicating a high level of interest.
A new draft, taking into account the opinions from the public comments, was also published at the 7th meeting of the Copyright Subcommittee of the Council for Cultural Affairs' Committee on Legal Systems. In the document 2-2 'Thoughts on AI and Copyright (Draft) as of February 29, Year 6 of Reiwa (with changes highlighted)', the changes were explained.
The idea is to put certain checks in place under the current law's interpretation to balance AI development with the protection of rights.
Considering examples from other countries and technological advancements, it is necessary to continue examining the regulatory approach. However, the ongoing research project for fiscal year 5 of Reiwa, 'Study on AI and Copyright in Foreign Countries' (Purpose of the study: To conduct research on AI and copyright in various countries as a basis for considering a system that addresses issues related to copyright law surrounding AI. Contractor: Mitsubishi UFJ Research & Consulting Co., Ltd., Research period: August 22, Year 5 of Reiwa to March 29, Year 6 of Reiwa, Countries and regions surveyed: EU, France, Germany, UK, USA, China, Singapore, Method of research: Literature and internet research, interviews with experts), is expected to reflect its results.
