化学発明における実施例の作成

化学の発明では、実施例の準備を巡って下記のようなことは打ち合わせでよくあることです。
弁理士「データが少な過ぎて実施例が書けませんサポート要件を満たすのに十分なデータを!もっと!データなんてなんぼあっても困りませんから!!」
発明者「そう言いますけどこっちは特許のためだけに 実験やってるわけじゃない!仮にデータを出してももっとくれって言いませんか?」
このあたりを、「少ないデータ」で「良い実施例を書く」方法を考える、過去の「良い実施例・明細書」から少ないデータでもよい場合を学ぶ、どんなときにデータを提供しどんなときにデータを提供しないかを明確にするという点から、うまく整理しているのが、11月6日開催された『化学発明における実施例の作成に必要なこと～「三方よし」のための実施例の準備とは～』（講師：IBC一番町弁理士法人、都祭 正則パートナー弁理士）です。

What’s Needed to Prepare Examples in Chemical Inventions
 
In chemical inventions, the following types of exchanges are common in discussions over preparing examples:
Patent attorney: 'There’s too little data to write the examples! We need enough data to meet the support requirement! More data! You can never have too much data!!'
Inventor: 'You say that, but we're not running experiments just for the sake of the patent! Even if we do provide data, won’t you just ask for more?'
The seminar held on November 6, titled “What’s Needed to Prepare Examples in Chemical Inventions—Creating Examples for the Benefit of All Parties” (hosted by Masanori Tomatsuri, partner patent attorney at IBC Ichibancho Patent Attorneys Office), effectively addresses this topic by organizing methods to write “good examples” with “limited data,” learning from past “well-prepared examples and specifications” when minimal data suffices, and clarifying when data should or should not be provided.
