パテント・インテグレーション：６件の特許権侵害訴訟提起

パテント・インテグレーションは、2024年10月25日に提起した訴訟、2024年11月27日提起した訴訟に引き続き、2024年12月24日に、Patentfieldに対する生成ＡＩに関する特許権の侵害訴訟を東京地方裁判所に提起したということです。
　「Patentfield AIR」だけでなく、「AI特許総合検索・分析プラットフォーム Patentfield」も対象となっているようです。
一方、Patentfieldは、11月26日と、12月24日に、「当社に対する特許権侵害訴訟の提起に関するお知らせ」をホームページにアップしています。『本件訴訟において原告は、「Patentfield AIR」の一部機能が、原告が既に提起している訴訟で侵害を主張している特許の分割特許1件についても侵害していると主張しております。』『なお、「AI特許総合検索・分析プラットフォーム Patentfield」および「Patentfield AIR」の当該機能以外の機能を含むその他のオプションサービスは、本件訴訟の対象外であることを弁護士より確認しております。』ということですので、2024年10月25日に提起した訴訟、2024年11月27日提起した訴訟では「Patentfield AIR」の一部機能が問題になっており、2024年12月24日に提起した訴訟では、「Patentfield AIR」だけでなく、「AI特許総合検索・分析プラットフォーム Patentfield」も対象となっているようです。
 
知財分野での生成AI活用が実用化段階に入っており、そのサービスの先頭に立っている両社の争いが、生成AI活用の阻害になることは避けていただきたいと思います。

Patent Integration: Filing of Six Patent Infringement Lawsuits
 
Patent Integration has filed yet another patent infringement lawsuit concerning generative AI against Patentfield at the Tokyo District Court on December 24, 2024, following its previous filings on October 25, 2024, and November 27, 2024. It appears that not only “Patentfield AIR” but also the “AI Patent Search and Analysis Platform Patentfield” is included in this latest lawsuit.
Meanwhile, on November 26 and December 24, Patentfield posted announcements on its website titled “Notice Regarding Filing of a Patent Infringement Lawsuit Against Our Company.” According to these announcements:
“In this lawsuit, the plaintiff asserts that certain features of ‘Patentfield AIR’ also infringe one of the divisional patents of the patents currently at issue in the pending litigation. Moreover, we have confirmed with our attorneys that other options and services, including features of the ‘AI Patent Search and Analysis Platform Patentfield’ and ‘Patentfield AIR’ not related to the functions at issue, are outside the scope of this lawsuit.”
Therefore, it appears that the lawsuits filed on October 25 and November 27, 2024, concern certain features of “Patentfield AIR,” whereas the lawsuit filed on December 24, 2024, targets not only “Patentfield AIR” but also the “AI Patent Search and Analysis Platform Patentfield.”
Since generative AI technology is now entering a practical phase in the intellectual property field—one in which both of these companies are leading players—one hopes that this dispute will not become a hindrance to the advancement and utilization of generative AI.
