サーチ漏れ、判断の均質性

産業構造審議会知的財産分科会 第2回審査品質管理小委員会が、令和6年3月15日（金曜日）～ 令和6年3月25日（月曜日）に、書面審理で行われているとのことで、3月19日に配布資料が公表されました。
「令和5年度審査品質管理小委員会報告書（案）」です。
特許審査では、『サーチ漏れの課題が抽出されており、今後とも審査官及び登録調査機関のサーチ能力の向上、サーチツールの開発等に努めて頂きたい。』『ユーザー評価調査の結果、優先的に取り組む項目として設定された「判断の均質性」等については、審査官間の判断の均質性を高める施策を引き続き実施していただきたい。』への取り組みを期待しています。

Search Omissions, Uniformity of Judgement
 
The 2nd Subcommittee on Examination Quality Management of the Intellectual Property Division of the Industrial Structure Council has been conducting written deliberations from March 15, 2023 (Friday) to March 25, 2023 (Monday), and the distribution materials were published on March 19.
It is the 'Fiscal Year 2023 Subcommittee on Examination Quality Management Report (Draft)'.
In patent examinations, issues of 'search omissions' have been identified, and it is hoped that efforts will continue to be made to improve the search capabilities of examiners and registration research institutions, as well as the development of search tools. Based on the results of the user evaluation survey, it is hoped that continued efforts will be made to implement measures to enhance the uniformity of judgement among examiners, as 'uniformity of judgement' has been set as a priority item to address.
