AIによりあらゆる発明が当たり前にできてしまう時代の特許制度

「2024知財・情報フェア＆コンファレンス」が10月2～4日、東京ビッグサイトで開催されるにあたって特許庁小野洋太長官が話した記事が掲載されていました。非常に大切な指摘です。
「大切なのは最初に知財ありきではなく、知財は経営を支えるもの。また、知財と経営はシンクロしているという点にある」
「経営には将来のビジョンがあり、どう実現するかの戦略がある。その際、自社の強みをどう生かし、弱みをどう克服するか。その打ち手として何に注力するかが問題となる。当然、その中に技術戦略やブランド戦略が含まれるが、そこへ知財や知財戦略が組み込まれていく」
そして、「昨今、生成人工知能（AI）を活用した発明や意匠などさまざまなコンテンツが創作物として認められるのかという問題も浮上している」という問いには、「特許制度そのものの問題で、今後議論をしていきたい。極端なことを言えば、あらゆる発明が当たり前にできてしまう。そのような時代では、特許制度は変わっていくのではないかという問題意識はある」という回答でした。

１０月７日には、構想委員会（第１回）が開催され、「知的財産推進計画2025」に向けた検討が始まります。生成AIの進歩は非常に速くなっており、発明発掘にもAIがしっかり関与し始めていますので、しっかり議論を牽引していただきたいものです。

The Patent System in an Era Where AI Makes Every Invention a Given
 
An article was published in which Yota Ono, Commissioner of the Japan Patent Office, spoke about the "2024 Intellectual Property and Information Fair & Conference" to be held at Tokyo Big Sight from October 2 to 4. His remarks are crucially important:
"The key is not to prioritize intellectual property (IP) first, but to understand that IP supports management. Also, IP and management are synchronized."
 
"Management has a vision for the future and a strategy to realize it. The question is how to leverage your company's strengths and overcome weaknesses. What to focus on as a measure becomes the issue. Naturally, this includes technology and brand strategies, and IP and IP strategies are incorporated into these."
 
Regarding the question, "Recently, there's an emerging issue of whether creations like inventions and designs using generative AI can be recognized as creative works," he responded, "This is a matter concerning the patent system itself, and we want to discuss it going forward. To put it extremely, we're entering an era where any invention could become commonplace. We are aware of the question of whether the patent system might need to change in such an era."
 
On October 7, the first meeting of the Concept Committee will be held, initiating discussions for the "Intellectual Property Promotion Plan 2025". As the progress of generative AI is accelerating rapidly and AI is beginning to be heavily involved in invention discovery, I hope for these discussions to be led effectively.
