AIを利活用した創作について

特許庁は、4月22日、「AIを利活用した創作の特許法上の保護の在り方に関する調査研究」（委員長：南山大学法学部　平嶋竜太教授）の調査結果を公表しました。本調査研究は、AIを利活用した創作の特許法上の保護の在り方に関して、公開情報調査、国内外へのアンケート、ヒアリングを実施し、これらの結果を踏まえた有識者委員会における議論を取りまとめたものです。
すでに発明の創作過程においてAIを活用している企業が14者(34%)で、今後活用する予定がある企業が15 者(37%)でした。
また、AIを活用している企業14 者を対象とした「現在の AIの技術水準は、発明を創作するために十分であるか。」という問いに対しては、「十分であると感じている。」（3 者、21%）、「十分であると感じていない。」（11 者、79%）という回答でした。AIの技術水準が十分ではないと考えている企業が多数ですが、十分であると感じている会社が2割もいることに驚きました。
 
AIを活用している企業におけるAI 活用の具体的な態様としては、下記の態様があがっていました。
✓ 課題候補の抽出（7 者、50%）
✓ 課題解決手段候補の抽出（13 者、93%）
✓ 用途候補の抽出（4 者、29%）
✓ 効果の検証（7 者、50%）
「現在活用していないが、今後活用する予定がある。」と回答した 15 者の予定している AI 活用の具体的な態様としては、下記の態様があがっていました。
✓ 課題候補の抽出（11 者、73%）
✓ 課題解決手段候補の抽出（10 者、67%）
✓ 用途候補の抽出（11 者、73%）
✓ 効果の検証（2 者、13%）
✓ その他（特許明細書等の文書作成、文書の校正）（2 者、13%）
 
発明の創作過程におけるAIの利活用が進行しそうです。

Regarding AI-utilized creations
 
On April 22, the Japan Patent Office (JPO) announced the results of the "Research and Study on How AI-based Creations Should be Protected under Patent Law" (Committee Chairman: Professor Ryuta Hirashima, Faculty of Law, Nanzan University). This study is based on a survey of publicly available information, questionnaires and hearings in Japan and abroad regarding how AI-enhanced creations should be protected under the Patent Law, and on discussions by a committee of experts based on the results of these surveys and hearings.
Fourteen companies (34%) are already using AI in the process of invention creation, and 15 companies (37%) have plans to do so in the future.
The question "Is the current level of AI technology sufficient for creating inventions? ”　The answer was "Yes" (21%, 3 respondents), "No" (79%, 11 respondents).
I was surprised to see that 20% of the companies felt that the level of AI technology was sufficient, although the majority of companies thought that it was not sufficient.
 
The following specific modes of AI utilization were mentioned by companies that are using AI.
✓ Identification of problem candidates (7 respondents, 50%)
✓ Identification of candidate solutions (13 respondents, 93%)
✓ Identification of candidate applications (4 respondents, 29%)
✓ Verification of effectiveness (7 respondents, 50%)
15 respondents who answered, "We are not currently using it, but we plan to use it in the future. The 15 respondents who answered "Not currently using AI, but have plans to use it in the future" indicated the following as specific ways in which they plan to use AI.
✓ Identification of problem candidates (11 respondents, 73%)
✓ Identification of candidate solutions (10 respondents, 67%)

The use of AI in the creation process of inventions is likely to progress.
