防衛的・受動的・リスク回避型の特許戦略の是非

他社の特許に無効理由があると判断していても無効審判はおこさない、一方、自社の特許に無効理由がないことが分かっていても権利範囲内の製品を認識していても他社に対して侵害を警告しない、他社から警告があった時に対抗手段として警告したり、無効審判を起こすという対応をスタンダードとしている会社があります。こうした対応は、リスクヘッジという点では理解できますが、自社の競争力をなくす方向になるのではないかと感じます。
こうした「他社の特許を積極的に攻撃せず、自社の特許権も他社からの攻撃に対する対抗手段としてのみ行使する戦略」(「受動的特許戦略」)について、生成AIに深掘りさせました。

The Pros and Cons of Defensive, Passive, and Risk-Avoidance Patent Strategies
There are companies that, even when they determine that another company’s patent has grounds for invalidation, do not file an invalidation trial. Likewise, even when they know their own patent has no grounds for invalidation and are aware of products falling within its claim scope, they do not issue infringement warnings to other companies. Instead, they take action—such as issuing warnings or filing an invalidation trial—only as a countermeasure when they themselves receive a warning from another company.
While such an approach is understandable from a risk-hedging perspective, I feel that it may lead to a loss of the company’s competitiveness.
Regarding this kind of “passive patent strategy”—where a company does not actively attack other companies’ patents and exercises its own patent rights only as a countermeasure against attacks from others—I had generative AI perform a deep-dive analysis.
