除くクレームの限界

パテント誌2025年6月号の「除くクレームの限界についての検討」（弁理士会令和5年度特許委員会第2部会第１チーム）は、おおざっぱに言うと、①特許庁審査・審判における除くクレームの成功事例が1045件失敗事例が77件（成功率93％）で除くクレームが特許査定につながりやすい、②除くクレームでうまくいかなかった事例を分析し、実務上の留意点（何を除くべきか、除くクレームの好ましい書き方、意見書における主張、出願時明細書について、除くクレームを使う際の確認事項、拒絶理由通知への対応時の留意点）がわかりやすくまとめられています。

This suggests that such claims often lead to a positive decision of patent grant.
2. Practical Insights from Unsuccessful Cases: The article analyzes examples where exclusion claims failed and clearly summarizes practical points for consideration. These include:
   • What should be excluded;
   • Preferred ways to draft exclusion claims;
   • How to argue effectively in written opinions;
   • Points regarding the specification at the time of filing;
   • Items to confirm when using exclusion claims;
   • Key considerations when responding to office actions.
