「特許・実用新案審査基準」改訂案

産業構造審議会 知的財産分科会 特許制度小委員会 審査基準専門委員会ワーキンググループ第18回会合(令和7年11月17日開催)・第19回会合(令和8年3月18日開催)で承認された改訂の方向性に従い、「特許・実用新案審査基準」の改訂案が作成され、意見募集が始まりました。意見募集期間は、令和8年4月8日(水曜日)~令和8年5月7日(木曜日)です。
主な改訂点として、引用発明との重複を避ける「除くクレーム」の補正について、新規事項の追加とみなされない具体例や判断指針が明確化されています。また、進歩性の判断において、引用文献の記載に固執せず当業者の視点や阻害要因の程度を総合的に評価する運用も示されました。さらに、外国語書面出願における翻訳の不備への対応や、同日出願があった際の協議手続きを効率化するための運用変更も含まれています。
生成AIに、この「特許・実用新案審査基準」の改訂案を深掘りさせ、意見案を作成させました。この改定案に関する課題はピックアップされているように思います。なお、生成AIによる調査・分析結果は、公開された情報からだけの分析であり、必ずしも実情を示したものではないこと、誤った情報も含まれていることについてはご留意されたうえで、ご参照ください。

Proposed Revisions to the “Examination Guidelines for Patents and Utility Models”
In accordance with the direction of revisions approved at the 18th meeting (held on November 17, 2025) and the 19th meeting (held on March 18, 2026) of the Working Group on Examination Guidelines under the Patent System Subcommittee of the Intellectual Property Committee of the Industrial Structure Council, a draft revision of the “Examination Guidelines for Patents and Utility Models” has been prepared, and a public comment process has commenced. The comment period runs from April 8, 2026 (Wednesday) to May 7, 2026 (Thursday).
The major points of revision include clarification of specific examples and examination criteria regarding amendments to so-called “excluding claims” (disclaimer claims) intended to avoid overlap with cited inventions, particularly in relation to whether such amendments constitute the addition of new matter. In addition, for the assessment of inventive step, the revised draft indicates an operational approach that does not rigidly adhere to the descriptions in cited documents, but instead comprehensively evaluates the perspective of a person skilled in the art and the degree of any teaching away (hindering factors).
Furthermore, the draft includes measures to address deficiencies in translations for foreign-language patent applications, as well as procedural changes aimed at improving the efficiency of consultations in cases of same-day filings.
A generative AI system was used to conduct an in-depth analysis of this draft revision of the “Examination Guidelines for Patents and Utility Models” and to prepare a set of comments. It appears that key issues related to this revision have been identified. However, please note that the analysis and findings generated by AI are based solely on publicly available information and may not necessarily reflect actual circumstances; they may also contain inaccuracies.
