イノベーション創出のための特許庁の取組

3月5日に開催された「産業構造審議会 第２０回知的財産分科会」では、「イノベーション創出のための特許庁の取組」「各小委員会の報告」について、議論されました。
資料１の「イノベーション創出のための特許庁の取組」のところでは、下記のページの説明が気になりました。
P.4　知財経営による「稼ぐ力」の強化：特許権を有している企業の方が営業利益率が高い、特許権の保有総数と営業利益率の関係営業利益率に相関がある
P.5　知財経営の概要：知財部門を中心に実施する部分が青で塗られた部分
P.6　中小企業における知財経営：イノベーション活動の実践や、稼ぐ力の強化といった点で、中小企業には改善の余地がまだまだ残されている。
P14  中堅企業における知財経営の実態に関する調査方針：中堅企業から大企業への成長割合は国際的に見ても低い状況にあり、中堅企業のポテンシャルを活かしきれていない可能性がある。
P23  機械的手法による技術動向調査の試行：従前は、抽出した文献を人手で読込み、調査を実施していたが、来年度からは試行的に、調査テーマごとに技術区分表と各技術区分に対応する検索式を作成する形式での調査を実施。
P28  特許審査とAIとの関係：特許審査のプロセス中、「分類付与」・「先行技術調査」においてAI技術を試行的に導入中。生成AI技術については、「分類付与」、「本願発明の理解」、「先行技術調査」等への適用可能性について調査研究を実施。
P56  アクション・プラン（令和６年度改定版）：各テーマの進捗状況や生成AI の発展を踏まえ、アクション・プラン（令和６年度改定版）を令和６年５月２０日に公表。

Japan Patent Office Initiatives for Innovation Creation
 
At the 20th Intellectual Property Subcommittee Meeting of the Industrial Structure Council held on March 5, discussions were held on the "Japan Patent Office Initiatives for Innovation Creation" and "Reports from Various Subcommittees."
In the material titled "Japan Patent Office Initiatives for Innovation Creation" (Document 1), the following pages caught my attention:

• Page 4: Enhancing Profitability through IP Management
  Companies holding patents tend to have higher operating profit margins. There is a correlation between the total number of patents held and operating profit margins.
• Page 5: Overview of IP Management
  The sections primarily executed by intellectual property departments are highlighted in blue.
• Page 6: IP Management in Small and Medium-sized Enterprises (SMEs)
  SMEs still have significant room for improvement in areas such as innovation practices and enhancing profitability.
• Page 14: Research Policy on the State of IP Management in Mid-sized Enterprises
  The proportion of mid-sized enterprises growing into large enterprises remains low by international standards, suggesting potential underutilization of mid-sized enterprises' growth capabilities.
• Page 23: Pilot Project for Technological Trend Analysis Using Mechanical Methods
  Traditionally, technology trend analysis was conducted by manually reading extracted documents. From the next fiscal year, a pilot program will implement an approach where technology classification tables and corresponding search queries will be created for each research theme.
• Page 28: Relationship Between Patent Examination and AI
  AI technology is currently being pilot-tested in patent examination processes, specifically in "classification assignment" and "prior art search." Regarding generative AI technology, studies are underway on its potential application to "classification assignment," "understanding claimed inventions," and "prior art search."
• Page 56: Action Plan (FY2024 Revised Edition)
  Considering the progress of each initiative and developments in generative AI, the revised Action Plan (FY2024 Edition) will be published on May 20, 2024.
