暗黙の知的財産同盟によるイノベーションの専有

後藤吉正氏の博士論文「暗黙の知的財産同盟によるイノベーション専有の可能性」は、「暗黙の知財同盟という戦略スキームが、イノベーションの専有可能性を可能にする」という仮説を検証したもので、この仮説は、インクジェットプリンタとDVDドライブの事例を用いて検証されています。
 
論文によれば、「暗黙の知財同盟とは、クロスライセンスやパテントプールなど特許権者の明示的な契約や合意によるアライアンスではなく、比較的少数の必須特許権者が、外部にも相互にも戦略的意思を明示せずに、必須特許の実施機会を必須特許権者が優先的に保有する戦略スキーム」です。
 
今年２月には、「暗黙の知財同盟  イノベーションの継続と収益化を両立する特許活用戦略」という書籍が出版されました。「暗黙の知財同盟」が、イノベーションの継続と収益化を両立する特許活用戦略の一つとして位置付けられているようです。

Monopolization of Innovation by the Implicit Intellectual Property Alliance
 
Dr. Yoshimasa Goto's doctoral thesis, 'The Possibility of Monopolizing Innovation through an Implicit Intellectual Property Alliance,' examines the hypothesis that the strategic scheme of an implicit intellectual property alliance enables the monopolization of innovation. The hypothesis is tested using the cases of inkjet printers and DVD drives.
 
According to the thesis, an implicit intellectual property alliance is a strategic scheme where a relatively small number of essential patent holders hold the implementation opportunities of essential patents preferentially, without explicitly disclosing their strategic intentions to each other or to outsiders, unlike alliances formed through explicit contracts or agreements such as cross-licensing or patent pools.
 
In February this year, a book titled 'Implicit Intellectual Property Alliance: A Patent Strategy that Balances Continuation of Innovation and Monetization' was published. The 'Implicit Intellectual Property Alliance' appears to be positioned as one of the patent utilization strategies that enable the continuation of innovation and its monetization.
