産業構造審議会知的財産分科会特許制度小委員会第54回小委員会

2025年6月4日に開催された産業構造審議会知的財産分科会特許制度小委員会第54回小委員会では、昨年11月からの討議を踏まえ、①AIの発明該当性②AIを活用した際の発明者の定義③AIを利用して生成した資料や論文などの「引用発明」の適格性について、特許庁として検討の方向性が示されました。次回の委員会は夏以降で「本格的な検討」を行う予定とのこと。

Industrial Structure Council — Intellectual Property Committee, Subcommittee on the Patent System, 54th Meeting
At the 54th meeting of the Subcommittee on the Patent System of the Intellectual Property Committee under the Industrial Structure Council, held on 4 June 2025, the Japan Patent Office outlined its intended direction of review—building on discussions since November of last year—regarding:

Whether inventions created with AI qualify as “inventions” under the Patent Act
The definition of “inventor” when AI is utilized
The eligibility of “cited inventions,” such as materials or academic papers generated with AI

The next meeting is scheduled for sometime after the summer, when a “full-scale review” is expected to take place.
