令和５年（行ケ）第１００９８号 周知技術

発明の名称を「衣料用洗浄剤組成物」とする特許発明について、当業者は引用発明及び出願日当時の周知技術に基づき、当該特許発明と当該引用発明との相違点に係る構成を導くことを容易に想到することができたものといえ、かつ、当該特許発明が奏する効果は当該特許発明の構成から当業者が予測することのできた範囲を超える顕著なものであったとは認められないとして、特許無効審判請求を不成立とした審決を取り消した事例。
『本件明細書の記載からは、「（Ａ）成分以外の界面活性剤」という意味での（Ｇ）成分は、含まれていてもよいという位置付けの成分であって、重要性が高くなかったものであり、本件発明１で特定された（Ｇ）成分に該当するＧ－２、Ｇ－２’及びＧ－３についても、本件防臭効果評価において、これらの成分を用いた実施例が他の実施例に比べて優れた防臭効果を得られていないのであって、これらのことからすれば、本件発明１において、（Ｇ）成分を一般式（Ｉ）又は一般式（ＩＩ）で表される少なくとも１種であるとし、一般式（ＩＩ）のＲ４を炭素数１２及び１４の天然アルコール由来の炭化水素と特定したことについて、格別の技術的意義があるとは認められない。』と明細書中の記載から相違点の技術的意義が認められず、主引例（甲１発明）と『甲１０、１１、１４、３６及び３７に記載された各周知技術』に基づいて進歩性が否定されました。
やはり、当初明細書中の記載にそれぞれの構成の技術的意義がしっかり記載されていないと、いろいろ取り繕っても、最後は設計事項としてバッサリ切られてしまうということでしょう。

With respect to the patented invention of "detergent composition for cleaning clothes", it can be said that a person skilled in the art could easily come up with the composition of the differences between the said patented invention and the said cited invention on the basis of the cited invention and the known technology at the time of filing the application. and that the effect of the patented invention was not considered to be significantly greater than what a person skilled in the art could have predicted based on the composition of the patented invention, the decision to dismiss the request for a trial on patent invalidation was reversed.
"From the description in the specification, component (G) is a component that may be included but is not important in the sense of 'surfactant other than component (A),' and even for components G-2, G-2', and G-3, which correspond to component (G) specified in Invention 1, in evaluating the deodorizing effect, the examples using these components did not achieve a superior deodorizing effect compared to other examples, and in view of these points, it cannot be said that there is any particular technical significance in the fact that the (G) component in the present invention 1 is at least one represented by the general formula (I) or the general formula (II), and that R4 in the general formula (II) is specified as a hydrocarbon derived from natural alcohols having 12 and 14 carbon atoms. The technical significance of the differences was not recognized based on the description in the specification, and the inventiveness was denied based on the main prior art (invention 1) and "any known technology described in 10, 11, 14, 36, and 37".
As I thought, if the technical significance of each component is not clearly stated in the initial specification, then no matter how much you try to patch things up, in the end it will be cut off as a design matter.
